Agreement to Terms

By accessing or using any FexWeb LLC service — including our website, subscription plans, or any deliverables — you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, do not use our services.

These Terms apply to all clients, visitors, and users of FexWeb LLC services. We reserve the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance of the revised Terms.

Your use of FexWeb services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you acknowledge that you have read and understood our Privacy Policy and consent to the collection, use, and disclosure of your information as described therein. If you do not agree to the Privacy Policy, you must discontinue use of our services immediately.

Services Provided

FexWeb LLC offers the following services based on your selected subscription plan:

• Custom or template-based website design and development
• Website hosting setup and configuration assistance
• Monthly website updates and maintenance (scope varies by plan)
• Basic on-page SEO (meta titles, descriptions, structured data)
• Social media profile setup and post scheduling (Pro and Premium plans)
• AI-powered website integrations (Premium plan)
• Priority email and call support (Premium plan)
• Project communication via SMS or text message for active clients who have provided a phone number

All services are delivered digitally. Timelines are estimates and may vary based on client responsiveness and project complexity.

Subscription & Payments

FexWeb operates on a monthly subscription model. Pricing is as follows:

• Starter — $99/month
• Pro — $199/month
• Premium — $399/month

By subscribing, you authorize FexWeb to charge your payment method on a recurring monthly basis. Payments are processed securely via Stripe. You are responsible for keeping your billing information current and accurate.

All charges are in USD. Taxes, if applicable, may be added based on your jurisdiction.

Free Trial

New clients are eligible for a 1-week (7-day) free trial on any plan. The trial begins on the date of signup.

• You will have full access to your selected plan's deliverables during the trial.
• No charge is applied during the trial period.
• You must cancel before the trial ends to avoid being billed for the first month.
• Free trials are available once per client. Abuse of the trial offer (e.g., creating multiple accounts) may result in suspension.

Cancellation & Refunds

You may cancel your subscription at any time by contacting us at contact@fexweb.com. Cancellation takes effect at the end of the current billing cycle.

• No refunds are issued for partial months already billed.
• If a technical error on our part results in an incorrect charge, a full refund will be issued promptly.
• Refund requests for other reasons will be reviewed on a case-by-case basis.
• Upon cancellation, your website may be taken offline unless hosting is managed independently.

Client Responsibilities

To ensure timely and accurate delivery of your website, you agree to:

• Provide accurate business information, content, images, and branding assets when requested.
• Respond to approval requests or feedback within a reasonable timeframe (typically 5 business days).
• Ensure all content you supply does not infringe on third-party intellectual property, trademarks, or copyrights.
• Not use FexWeb services for unlawful, fraudulent, or harmful purposes.
• Notify FexWeb promptly of any login credentials, domain, or hosting changes that may affect service delivery.

Delays caused by late client responses may affect project timelines. FexWeb is not liable for missed deadlines resulting from client inaction.

Intellectual Property

Upon full payment of all amounts owed, clients receive a non-exclusive license to use the website design and content created specifically for their project.

• FexWeb retains ownership of all underlying code frameworks, design systems, templates, and proprietary tooling.
• Clients may not resell, redistribute, or claim ownership of FexWeb's proprietary assets.
• Any third-party assets (fonts, icons, stock images) remain subject to their respective licenses.
• FexWeb reserves the right to display completed work in its portfolio unless the client requests otherwise in writing.

Limitation of Liability

To the fullest extent permitted by law, FexWeb LLC shall not be liable for:

• Loss of revenue, profits, or business opportunities resulting from website downtime or errors
• Inaccurate content submitted by the client
• Outages or failures of third-party services (hosting providers, payment gateways, DNS providers)
• Data loss resulting from factors outside FexWeb's direct control
• Any indirect, incidental, or consequential damages arising from use of our services

FexWeb's total liability to any client shall not exceed the total fees paid by that client in the 30 days preceding the claim.

Privacy

FexWeb collects only the information necessary to deliver our services — including your name, email address, and billing details. We do not sell, rent, or share your personal data with third parties for marketing purposes.

Payment data is processed and stored securely by Stripe. FexWeb does not store full card numbers or CVV codes. Stripe is independently responsible for the security of payment data processed through its platform. By using our services, you consent to our collection and use of data as described here.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from or related to these Terms or FexWeb services shall be resolved through good-faith negotiation. If unresolved, disputes may be submitted to binding arbitration.

SMS & Text Message Communications

By providing your phone number to FexWeb LLC, you consent to receive transactional and project-related SMS or text messages from us. These messages may include updates about your project status, billing reminders, and support communications.

Message and data rates may apply. Message frequency varies based on project activity. You may opt out at any time by replying STOP to any text message. For help, reply HELP.

We will not share your phone number with third parties for their marketing purposes. SMS consent is not a condition of purchase.
